EUSS requirements - difficulties raised with the Home Office

Settled recently wrote to Seema Malhotra MP, the new Minister for Migration and Citizenship at the Home Office. Based on our casework experience, we outlined concerns about difficulties faced by particular client groups in applying for EUSS status. 

Concerns included:

  • Women and young people, particularly in the Roma community, who lack what the Home Office considers ‘Preferred evidence of residence’; 
  • ‘Durable partners’ who do not cohabit;
  • Applicants who lack capacity to instruct an adviser;
  • Delayed decisions;
  • Confusion about pre-settled status and the continuous residency requirement.

We offered a proposal to address each issue.
